📜 TERMS OF USE

1. LEGAL NOTICE & LIABILITIES

Vincent Piton, Sole proprietorship under the micro-entrepreneur regime, registered in the SIRENE directory under SIREN number 840 667 414, with headquarters located at 54 rue Amiral Lacaze, 97410 Saint-Pierre, is the publisher of the mobile application and website Druidz (hereinafter "the Application" or "the Service"), dedicated to publishing recipes related to plants (edible, medicinal or otherwise).

Druidz is an information, observation, and nature knowledge sharing application.

This document constitutes the terms of use of the Application, including these legal notices and liability commitments. By accessing the Application or using it, you (hereinafter the "User") accept these terms without reservation.

2. CRITICAL WARNING – FATAL IDENTIFICATION RISKS

⚠️ MANY PLANTS, AS WELL AS MANY WAYS OF USING PLANTS CAN BE TOXIC AND LEAD TO DEATH! ☠️

This is the most serious risk of this application.

Identification errors can occur at ALL levels:

  • SOURCE DATABASES: Botanical data (GBIF, Pl@ntNet, etc.) may contain identification errors, obsolete synonyms, taxonomic confusions
  • CONTRIBUTORS: Users may misidentify a plant during entry, confuse similar species, use ambiguous vernacular names. Additionally, spot assessments (access authorization, pollution level, plant abundance) are provided by contributors and constitute unverified indicative information that in no way replaces your own on-site verifications and compliance with local regulations
  • ARTIFICIAL INTELLIGENCE: AI may propagate or amplify existing identification errors in its sources
  • YOURSELF: Major risk of confusion between edible and toxic species of similar appearance (e.g.: wild garlic/lily of the valley, wild carrot/hemlock)
  • RECIPES: Basic recipes generated by AI are not supported by any health authority. User recipes are not verified and may be toxic. Preparation methods (cooking time, dosage) can render a plant toxic or even lethal. Related risks: unknown allergies, plant contamination, parasites, drug interactions, etc.

⚠️ NEVER consume or use a plant without 100% certain identification by an expert. In case of doubt, COMPLETE ABSTENTION. No photo, description or fact sheet replaces direct examination by a qualified botanist.

🔞 MINIMUM AGE AND PARENTAL SUPERVISION

3.1 Minimum age required

The use of Druidz is reserved for persons aged 15 or over, in accordance with French legislation on the protection of personal data (law of July 7, 2023).

3.2 Users under 15 years of age

Minors under the age of 15 may only use the application with the explicit joint consent of a holder of parental authority.

3.3 Enhanced parental responsibility

⚠️ CRITICAL WARNING: This application contains information about potentially TOXIC and FATAL plants.

By authorizing a minor to use Druidz, the parent or legal guardian:

  • acknowledges having read the critical safety warnings,
  • accepts responsibility for ACTIVELY supervising the minor's use,
  • undertakes to train the minor in the risks of misidentification,
  • understands that an identification error can lead to death,
  • releases the Publisher from all liability in the event of inappropriate use.

⚠️ It is STRONGLY DISCOURAGED for minors under 18 years of age to use the application without active supervision by an adult competent in botany or wild foraging.

3.4 Age verification

The Publisher reserves the right to request age verification or parental consent at any time. In case of doubt or report, the account may be suspended until verification.

4. TOXIC PLANTS DATABASE

The Application integrates a database currently listing 6,834 toxic plant species. This list, while extensive, IS NOT EXHAUSTIVE and will likely continue to evolve in the future. The number of species identified as toxic is likely to increase with the evolution of scientific knowledge and the development of the application.

☠️ CRUCIAL WARNING: THE ABSENCE OF A PLANT IN OUR LIST OF TOXIC PLANTS ABSOLUTELY DOES NOT GUARANTEE THAT THIS PLANT IS EDIBLE OR SAFE!

It is IMPERATIVE to always perform MORE checks than seems necessary. SYSTEMATICALLY CROSS-REFERENCE MULTIPLE RELIABLE SOURCES before any use of a plant. The absence of a toxic symbol (☠️) next to a plant DOES NOT MEAN that it is edible or safe for health.

By default, our system prevents the use of plants listed as toxic in recipes intended for consumption. However, we allow the writing of content mentioning these toxic plants in a non-edible context (bushcraft) ONLY FOR CULTURAL AND KNOWLEDGE-SHARING PURPOSES. This freedom is granted because, in certain very specific cases, toxic plants have had or still have particular uses requiring extreme expertise and precautions.

We STRONGLY ADVISE AGAINST any practical use of plants listed in our toxic plants list, regardless of the suggested preparation. The responsibility for the accuracy of the information shared rests entirely with the user who publishes it, and the Publisher disclaims all responsibility for the potentially fatal consequences of misidentification or misuse of a plant.

DATA SOURCES AND LICENSES

The Druidz service integrates data from open, scientific and contributory third-party sources, including institutional and collaborative databases, made available under Creative Commons licenses (CC0, CC BY, CC BY-NC).

Each source is mentioned with attribution and reference to the applicable license. Third-party data remains the property of their respective producers and remains subject to their original licenses.

ACCESS TO OPEN DATA

Data from open sources is freely accessible via the Druidz service in online mode, subject to network availability.

The Premium subscription does not condition access to this data and does not confer any additional rights to it.

OFFLINE MODE

Offline mode allows the User to download and store maps and data already accessible online locally, in order to use them without a network connection.

The Premium subscription provides access to technical features for downloading, local storage, quota management and associated tools.

Data accessible offline is identical to that accessible online and remains subject to their respective licenses.

NO DATA SALES

The Premium subscription corresponds exclusively to the provision of technical services, software tools and infrastructure allowing offline and advanced use of the service.

Druidz does not sell or grant commercial rights to third-party data accessible via the service.

LIABILITY RELATED TO THIRD-PARTY LICENSES

The User is responsible for complying with the licenses applicable to the data they consult, download or reuse via the Druidz service.

Druidz cannot be held responsible for use by the User that does not comply with the licenses.

5. SERVICE USAGE MODES (FREE / PREMIUM)

The Druidz Application offers two distinct usage modes, catering to different uses.

4.1 Free Mode (Local Discovery)

The free mode allows any user to freely access the Application's content within a limited geographic area around their location.

This mode aims to:

  • allow everyone to discover nature, plants, and uses around their place of residence;
  • guarantee free access to local knowledge, without payment obligation;
  • promote an initial educational and responsible approach to the environment.

In free mode:

  • online content access covers all global data;
  • a one-time offline mode trial may be offered at account creation, in the form of a limited test zone;
  • advanced offline navigation features with renewable quotas are reserved for Premium mode.
💡 Note: Global online access remains free. The one-time offline trial may change or be removed due to technical constraints, without notice.

4.2 Premium Mode (Extended Exploration)

Premium mode is intended for users wishing to use the Application for broader, regular, or itinerant exploration.

It notably allows:

  • exploration beyond the free zone;
  • full access to mapping and exploration features;
  • download of content for offline use.

The transition to Premium mode is not intended to restrict access to knowledge, but to finance:

  • technical infrastructure;
  • mapping services;
  • the development and maintenance of the Service.
The user remains free to use the Application exclusively in free mode.

6. AI-GENERATED CONTENT

The Application may provide certain content automatically generated by an artificial intelligence system (for example, recipe suggestions, plant descriptions, or general advice). This AI-generated content is provided for informational purposes only.

Processing may be performed locally on the device or via remote services depending on the functionality.

Although the Publisher strives to improve the quality of this information, it may be inaccurate, incomplete, or unsuitable. The Publisher in no way guarantees that AI-generated content will be free of errors, omissions, or misleading elements.

You must exercise discernment and verify for yourself any information from AI before using it or relying on it. Furthermore, you are solely responsible for the use you make of this automated content.

It is your responsibility to verify that your interactions with AI and the use of generated results are appropriate and comply with these terms. The Publisher disclaims all responsibility for actions taken by the User based on content provided by AI.

⚠️ Recipes generated by AI are provided without any guarantee as to their safety, edibility, or compliance with health standards. Although the Application strives to filter known toxic plants, AI systems may make errors or suggest potentially dangerous ingredient combinations. The User uses these recipes at their own risk and the Publisher disclaims all responsibility for the consequences of their use.

7. THIRD-PARTY BOTANICAL DATA SOURCES

Species sheets and taxonomic information disseminated on the Application may be automatically aggregated from open or collaborative databases such as GBIF.org, Pl@ntNet, iNaturalist, Muséum national d'Histoire naturelle (MNHN), Catalogue of Life, Tropicos, as well as other free or compatible license datasets.

Although these resources are considered quality, their accuracy is not guaranteed: misidentified taxa, outdated synonyms, erroneous locations, or incomplete data may persist.

The Publisher only relays this information for illustration and education purposes, without certification. Any decision to forage, consume, or use therapeutically must therefore be based on cross-referencing (scientific literature, local experts, regional floras) and direct observation of the plant.

The User remains fully responsible for the consequences of inaccurate identification.

8. THIRD-PARTY SERVICES – NO GUARANTEE OF AVAILABILITY, PERFORMANCE, AND NO OBLIGATION OF RESULT

The Application depends on multiple external technical services, including:

  • Pl@ntNet (image identification),
  • MapTiler and Google Maps Platform for maps and tiles,
  • Google Cloud Platform (GCP) for hosting, processing, and storage,
  • GBIF.org, FallingFruit.org, Refuge.info, OpenStreetMap and other free or collaborative datasets.

As these services are provided by independent third-party entities, the Publisher exercises no control over their operation, availability, quality, performance, APIs, quotas, throughput, or any interruptions.

Consequently:

  • No guarantee of availability, stability, continuity, or performance of the Service is provided.
  • The Application may experience at any time slowdowns, disconnections, loading errors, map interruptions, server failures, API limitations, or data loss.
  • No refund, total or partial, nor any compensation, may be demanded due to temporary or prolonged unavailability, malfunction, identification error, or performance degradation of the Service or any of its technical providers.

The Publisher provides the Service without any obligation of result, only with an obligation of reasonable means. The User expressly acknowledges that access to the Application is subject to numerous technical constraints and accepts the use of the Service "as is" and "as available", without any guarantee of any kind.

9. PL@NTNET – NO IDENTIFICATION GUARANTEE

Identifications made via Pl@ntNet come from an independent third-party service. The Publisher in no way guarantees:

  • the accuracy of identifications,
  • the reliability of proposals,
  • the relevance of results,
  • the availability or performance of the service,
  • the absence of error, ambiguity, or confusion between species.

Any identification must be verified by the User with reliable sources and/or a competent expert. The Publisher disclaims all responsibility for the consequences of misidentification or inappropriate use of a plant.

10. NO MEDICAL, DIETARY, OR THERAPEUTIC ADVICE

The information in the Application, including that generated by AI, databases, or users:

  • does not constitute medical, dietary, nutritional, or therapeutic advice,
  • does not replace consultation with a healthcare professional,
  • does not guarantee the safety of medicinal or food use of a plant.

Any use of plants (ingestion, topical application, infusion, decoction, maceration, etc.) must be validated by a competent professional. The User acknowledges using this information at their own risk.

11. USE AT YOUR OWN RISK

The User acknowledges that the use of the Application, identifications, recipes, photos, locations, map data, and community contributions:

  • is done under their sole responsibility,
  • may involve serious or fatal risks in case of error,
  • must always be verified by multiple reliable sources,
  • requires formal identification of the plant by an expert and strict compliance with local regulations.

The Publisher disclaims all responsibility for consequences resulting from:

  • erroneous identifications,
  • incorrect interpretations,
  • inappropriate or dangerous use of plants,
  • errors from third-party services,
  • non-compliance with warnings and precautionary recommendations.

12. MODIFICATIONS, SUSPENSION, AND INTERRUPTION OF SERVICE

The Publisher reserves the right, at any time and without notice, to modify, suspend, limit, or interrupt all or part of the Application or its features, including paid features.

No modification, suspension, or interruption of the Service may give rise to any compensation, refund, or indemnification, the User acknowledging using the Application "as is" and "as available".

13. USER-GENERATED CONTENT (UGC)

The Application is a community platform allowing registered users to publish content related to plants and their uses, particularly in the form of recipes, comments, photos, or tips (User Generated Content or "User Content").

Each User is entirely responsible for the content they publish on the Service.

The Publisher does not exercise prior editorial control over User Content, which is published in real time under the exclusive responsibility of its author. As such, the opinions, advice, and information expressed by users do not necessarily reflect the Publisher's point of view, and the Publisher does not guarantee their accuracy or relevance.

⚠️ Despite filtering systems in place for toxic plants, the Publisher cannot guarantee the total absence of dangerous content. The User acknowledges that even if a recipe has passed the Application's security filters, the Publisher can in no way be held responsible for damages resulting from its use. The User also acknowledges that the presence of a recipe on the Application does not in any way constitute validation of its safety by the Publisher.

14. HOSTING PROVIDER STATUS AND ABUSE NOTIFICATION

The Publisher acts as a hosting service provider within the meaning of applicable regulations (notably Article 6.I.2 of French Law No. 2004-575 of June 21, 2004 for confidence in the digital economy, the European Digital Services Act, and §230 of the Communications Decency Act in the USA).

As such, the Publisher is not subject to a general obligation to monitor content published by users. Its liability can only be engaged if it does not promptly remove manifestly illegal content after having effective knowledge of it.

Any User or third party believing that User Content violates the law, third-party rights, or these terms may report it to the Publisher via the Application's features or by contacting druidzcontact@gmail.com.

The Publisher reserves the right to remove or moderate any reported or deemed inappropriate User Content, without notice or justification.

15. PROHIBITED CONTENT

It is STRICTLY PROHIBITED to publish on the Application content promoting:

  • Psychotropic substances or narcotics: Any recipe, article, or comment suggesting the use of plants for recreational, hallucinogenic, or psychotropic purposes is strictly prohibited.
  • Protected species: Any proposal to forage, consume, or exploit plant species protected by law (national or international) is prohibited.
  • Illegal acts: More generally, any content encouraging or facilitating illegal activity is strictly proscribed.

The Publisher reserves the right to immediately delete any content violating this rule and to suspend or permanently ban the author's account without notice.

16. PROTECTED AREAS AND LOCAL REGULATIONS

The User must comply with local, national, and international laws and regulations regarding plant foraging, including:

  • Prohibition of foraging in national parks, nature reserves, classified sites, and protected areas.
  • Compliance with foraging quotas and authorized periods (if applicable).
  • Prohibition of collecting protected, threatened, or endangered species.

⚠️ The Application does not provide comprehensive information on regulations in force. It is the User's responsibility to inform themselves and ensure the legality of their actions before any foraging or use of plants.

17. USER RESPONSIBILITY

The User acknowledges and accepts that the use of the Application and its content is done under their sole and entire responsibility.

The User commits to:

  • Identification verification: Confirm by themselves the exact identity of any plant before foraging or consuming it.
  • Toxicity assessment: Ensure that the plant considered is not toxic, allergenic, or dangerous for themselves or others.
  • Compliance with legality: Verify that the foraging and use of the plant are authorized and comply with applicable laws and regulations.

⚠️ The User acknowledges that the Publisher can in no way be held responsible for consequences resulting from erroneous identification, inappropriate consumption, or violation of regulations in force.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Publisher and its officers, employees, partners, and service providers can in no way be held liable for direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to:

  • Intoxications, poisonings, allergies, or any other health problem resulting from consumption or use of a misidentified or misprepared plant.
  • Material or bodily damage resulting from incorrect use of the Application.
  • Data loss, service interruption, or any other technical malfunction.

The Application is provided "as is", without any warranty, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

⚠️ The Publisher does not guarantee the accuracy, completeness, or reliability of information provided by the Application, whether from AI, third-party databases, or user contributions.

19. INDEMNIFICATION

The User agrees to hold harmless, defend, and indemnify the Publisher, its officers, employees, partners, and service providers against any claim, action, loss, damage, cost, or expense (including, without limitation, reasonable attorneys' fees) arising from or related to:

  • The use of the Application and the information it contains.
  • The publication of User Content contrary to these terms or law.
  • Any violation of these Terms of Use by the User.
  • Any infringement of third-party rights (including intellectual property rights, right to image, defamation).

This includes, but is not limited to, all legal fees, attorneys' fees, and other defense costs that the Publisher may incur due to legal action related to the User's activities on the Application.

20. INTELLECTUAL PROPERTY

The Application, its content (texts, images, logos, trademarks, databases, source code, design, etc.) and associated intellectual property rights are the exclusive property of the Publisher or its licensors, unless otherwise stated.

Any reproduction, representation, modification, publication, adaptation, total or partial, of the Application or its content, by any process whatsoever, without the prior written authorization of the Publisher, is prohibited and constitutes infringement sanctioned by Articles L.335-2 and following of the French Intellectual Property Code.

By publishing User Content on the Application, the User retains all copyright and:

1. Places their content under Creative Commons Attribution – Non Commercial 4.0 International (CC BY-NC 4.0) license for the public and the community.

This license allows the public to share and adapt the content for non-commercial purposes, provided proper attribution is given to the author.

2. Grants Druidz a specific, non-exclusive, worldwide and free authorization, including commercial use, strictly limited to the needs of operation, improvement, promotion and technical operations of the Druidz service, for the legal duration of rights protection.

This authorization does not entail any transfer of ownership to Druidz.

21. MODERATION AND VOTING SYSTEM

The Application implements a community moderation system allowing users to vote for or against published content (plants, recipes, comments). Positive votes (upvotes) and negative votes (downvotes) allow content to be ranked according to its relevance and reliability as perceived by the community.

However, the Publisher reminds that highly upvoted content is not necessarily accurate or safe, and downvoted content is not necessarily erroneous.

The User acknowledges that votes reflect the subjective opinion of the community and do not constitute scientific or professional validation of the content.

22. TRANSLATIONS AND MULTILINGUAL CONTENT

The Application allows users to translate recipes into other languages. The User can:

  • Access a link to a third-party translation tool (for example, DeepL) with pre-filled content.
  • Copy the generated translation and paste it into the Application to create a translated version of the recipe.

21.1 Responsibilities

  • The original author of the recipe remains the owner of their content and responsible for the accuracy of information in the original language.
  • The translator is responsible for the accuracy and quality of the published translation. By publishing a translation, the translator certifies that it is faithful to the original content.
  • The Application and the Publisher are not responsible for errors or omissions in translations, whether from a third-party tool or a user.
  • The use of a third-party translation tool is subject to the terms of use of that tool. The Publisher is not responsible for the availability, quality, or security of third-party services.

23. ACCESSIBILITY

The Publisher strives to make the Application accessible to as many people as possible, in accordance with applicable accessibility standards.

However, the Publisher does not guarantee that the Application will be fully accessible to all users, particularly due to the diversity of devices, browsers, and assistive technologies.

24. APPLICABLE LAW

These Terms of Use are governed by and interpreted in accordance with French law, without regard to conflict of law principles.

25. ENTIRE AGREEMENT

These Terms of Use / Legal Notice constitute the entire agreement between the Publisher and the User regarding the use of the Application, and replace and cancel any prior understanding, communication, or agreement – oral or written – relating to the same subject.

They prevail over any summary document or automated summary of the terms that may be provided elsewhere for educational or convenience purposes.

26. JURISDICTION

Any dispute relating to the interpretation or execution of these Terms of Use shall be submitted, failing amicable agreement, to the exclusive jurisdiction of the competent French courts.

27. REFERENCE LANGUAGE

In case of translation of these Terms of Use into one or more languages, only the French version is authoritative in case of divergence of interpretation.
