1. DESCRIPTION OF PREMIUM SERVICES

1.1 Premium Subscriptions

Druidz offers two Premium subscription options:

🌿 Monthly Premium ($4.99/month)

• Download quota: 1000 tiles per month (approximately 300 km of trail)
• Automatic renewal every month
• Cancellable at any time

🌍 Annual Premium ($34.99/year, or $2.92/month)

• Download quota: 12000 tiles per year (approximately 3600 km of trail)
• Automatic renewal every 12 months
• Cancellable at any time
• Save 41% compared to monthly

1.2 Premium Features

Premium subscriptions unlock the following features:

• Download offline maps (MBTiles) for offline navigation
• Offline access to plant data, shelters and observations
• Download recipes and content for offline use
• Global great treks catalog
• Offline access to downloaded content as long as it is kept on the device

2. DOWNLOAD QUOTAS

2.1 Tile System

The download quota is expressed in tiles. A tile represents a rectangular geographic area of the map.

Approximate conversion:

• 1000 tiles ≈ 300 km of trail (surrounded by a buffer zone)
• 12000 tiles ≈ 3600 km of trail

2.2 Quota Renewal

Monthly Subscription:

• Monthly quota: 1000 tiles
• Reset: On your subscription anniversary date (each month)
• The used tiles counter is reset to zero at each renewal

Annual Subscription:

• Annual quota: 12000 tiles
• Reset: On your subscription anniversary date (12 months after subscription)
• The used tiles counter is reset to zero at annual renewal

2.3 Downloaded Content Retention

Example: If you downloaded 700 tiles in October and your monthly quota of 1000 tiles renews in November, you keep the 700 tiles downloaded in October AND you have a new quota of 1000 tiles for new downloads in November.

3. TOP-UPS (TILE RECHARGES)

3.1 Description

Top-ups are unit-purchasable download quota recharges:

• 1000 tiles for €2.49 (approximately 300 km of trail)
• Purchase reserved for Annual Premium subscribers only
• Once purchased, usable with any Premium subscription (Monthly or Annual)
• Cumulative without limit
• Validity without time limit

3.2 How Top-ups Work

Purchase:

• Top-ups are immediately added to your subscription quota
• Example: Annual subscription (12000 tiles) + Top-up (1000 tiles) = 13000 available tiles

3.3 Top-ups and Subscription Cancellation

Behavior upon cancellation:

If you cancel your Premium subscription:

1. Your subscription quota (1000 or 12000 tiles) is reset to zero
2. Your purchased top-ups are retained but frozen
3. You cannot use your top-ups in free mode (free mode does not offer renewable offline quota)
4. Already downloaded content remains accessible offline

Reactivation:

If you reactivate a Premium subscription (Monthly or Annual):

1. Your new subscription quota is activated (1000 or 12000 tiles)
2. Your previously frozen top-ups are automatically unlocked
3. Total available quota = Subscription quota + Top-ups

4. PAYMENT AND BILLING

4.1 Payment Method

Payments are securely processed by Stripe (PCI-DSS certified payment provider).

Accepted payment methods:

• Credit card (Visa, Mastercard, American Express)
• Debit card
• Other methods available depending on your country

4.2 Automatic Renewal

Monthly Subscriptions:

• Automatic charge every month on your subscription anniversary date
• Amount: €4.99 incl. tax

Annual Subscriptions:

• Automatic charge every 12 months on your subscription anniversary date
• Amount: €34.99 incl. tax

4.3 Payment Failure

In case of payment failure:

Grace period (3-7 days):

• Subscription status: "Payment late"
• Premium access: Retained during grace period
• You receive a notification to update your payment information

After grace period (if payment still failed):

• Subscription status: "Unpaid"
• Premium access: Suspended
• Your account switches to free mode (global online access only)
• Your top-ups are frozen (not lost)
• Already downloaded content remains accessible offline

5. CANCELLATION AND TERMINATION

5.1 Right of Withdrawal (14 days)

In accordance with consumer protection laws, you have 14 days to exercise your right of withdrawal without having to justify reasons or pay penalties.

By validating your purchase, you request immediate service execution. You acknowledge that in case of service use (notably content download or Premium feature activation), you lose your right of withdrawal in accordance with consumer protection regulations.

Right of withdrawal terms:

If you HAVE NOT used the service:

• Period: 14 days from subscription
• Full refund within 14 days following your request
• Contact: druidzcontact@gmail.com
• Condition: You must not have downloaded maps or used Premium features

If you HAVE ALREADY used the service:

• The right of withdrawal no longer applies (digital service already executed)
• Your subscription remains active until its expiration
• You can cancel it to avoid renewal, but without refund of the current period

5.2 Subscription Cancellation

You can cancel your subscription at any time via:

1. From mobile app: Settings → "Manage my subscription" button (Stripe secure portal)
2. From web: Stripe Portal (email verification code)

Effect of cancellation:

• Your subscription remains active until end of paid period (recommended)
• You keep Premium access until expiration
• No automatic renewal
• At expiration: switch to free mode (global online access only) and top-ups freeze

5.3 What happens after cancellation?

Your account switches to free mode:

• Global online access maintained
• Offline quota: 0 tiles (offline quotas reserved for Premium)
• Already downloaded content remains accessible offline as long as it is kept on the device
• Your purchased top-ups are retained but frozen (not lost)
• Reactivation possible at any time

6. SUBSCRIPTION CHANGE

6.1 Switch Monthly → Annual

Benefits:

• Immediate saving of 41% ($2.92/month instead of $4.99/month)
• More generous annual quota: 12000 tiles instead of 12000 cumulative tiles (12 × 1000)

Change terms:

To switch from Monthly to Annual:

1. Go to Settings → ⚙️ Manage my subscription in the app
2. Click on "Update plan"
3. Select "Annual Premium ($34.99/year)"
4. Stripe automatically calculates a proportional credit for remaining time of your monthly subscription
5. You only pay the difference

6.2 Switch Annual → Monthly

The Annual → Monthly switch is considered a downgrade.

Billing:

• Your Annual subscription continues until its expiration date
• Monthly starts automatically at Annual end
• No refund of current Annual (period already paid and usable)
• Stripe only charges the first Monthly at Annual end

7. DATA AND CONTENT

7.1 Data Retention

Downloaded content:

• Downloaded MBTiles maps, plants, recipes and trails are stored locally on your device
• They remain accessible offline as long as they are kept on the device, even after:
  • Quota expiration
  • Subscription cancellation
  • Switch to free mode

Account data:

• Your milestones, XP and statistics are retained indefinitely
• Deletion possible upon request (GDPR)

8. CREATIVE COMMONS LICENSE FOR USER CONTENT

8.1 CC BY-NC 4.0 License

By publishing content on Druidz (observation, geographic point, text, image, data or any other element), the user retains all copyright and places their content under Creative Commons Attribution – Non Commercial 4.0 International (CC BY-NC 4.0) license for the public and the community.

8.2 Rights Granted to the Public

This license allows the public and the community to share and adapt the content for non-commercial purposes, provided proper attribution is given to the author.

8.3 Specific Authorization Granted to Druidz

In addition to the CC BY-NC license, the user grants Druidz a specific, non-exclusive, worldwide and free authorization, including commercial use, strictly limited to the needs of operation, improvement, promotion, technical operations and scientific research of the Druidz service, for the legal duration of rights protection.

This authorization does not transfer any ownership.

8.4 Attribution

Any reuse must credit the original author and indicate if modifications have been made.

8.5 Retention After Deletion

In case of account deletion, published content may be retained in anonymized form, within the framework of the authorization provided in article 8.3.

9. TRANSPARENCY AND TRACEABILITY

9.1 Quota Display

The app permanently displays in Settings:

• Your subscription type (Monthly or Annual)
• Your Premium subscription activation date
• Your total subscription quota (in tiles)
• Your used quota
• Your remaining quota
• Your purchased top-ups (separate from subscription quota)
• Your total available quota (subscription + top-ups)

9.2 Frozen Top-ups

If you are in free mode (global online access only, without offline quota) and have previously purchased top-ups, the app displays:

• The amount of frozen top-up tiles
• An explanatory message: "Reactivate a Premium subscription to unlock your top-ups"

10. SUBSCRIPTION MANAGEMENT

10.1 Stripe Customer Portal

You can manage your subscription via the secure Stripe customer portal:

• View your invoices
• Update your payment method
• Change plan (Monthly ↔ Annual)
• Cancel your subscription

Portal access:

• From app: Settings → "Manage my subscription"
• From web: Stripe Portal

11. SPECIAL SITUATIONS

11.1 Payment Failure

In case of recurring payment failure (expired card, insufficient funds), Stripe automatically attempts several retries over 3 to 7 days. If payment definitively fails, your subscription is cancelled and your account switches to free mode.

11.2 Suspended or Banned Account

In case of Terms of Use violation or abusive behavior, Druidz reserves the right to suspend or ban your account. In this case:

• Your subscription is cancelled immediately
• No refund of current period
• In case of proven fraud or serious Terms of Use violation, Druidz reserves the right to cancel unused top-ups, without refund.
• Access revoked to the application

12. REFUNDS

12.1 Refund Policy

Refunds are only possible in the following cases:

• Right of withdrawal (14 days): Full refund if you have not used the service
• Billing error: Refund within 14 days after verification
• Double charge: Refund of excess amount within 14 days

12.2 No Refund

No refund is possible in the following cases:

• Cancellation during period (you already paid for current period)
• Subscription change (Annual → Monthly downgrade)
• Suspended or banned account for Terms of Use violation
• Service dissatisfaction after use (right of withdrawal expired)

13. DOWNLOAD QUOTAS, OFFLINE MAPS AND NO REFUND

13.1 Service Nature

Offline map download and cartographic file (MBTiles) download features constitute a digital service with immediate execution, based on use of a data quota associated with the user's account.

Each validated download entails definitive quota consumption, once the download process is fully completed.

13.2 No Refund After Consumption

In accordance with consumer protection regulations, the user acknowledges and expressly accepts that:

• starting offline map download constitutes immediate service execution;
• total or partial quota consumption makes the service non-refundable.

No refund can be granted when quota has been consumed, notably in the following cases:

• offline map download performed by user;
• poor estimation of downloaded area;
• application uninstallation;
• phone or system change;
• absence of export or backup of files outside application.

13.3 Local Storage and User Responsibility

Offline maps are stored locally on the user's device, in the application's secure environment, in accordance with iOS and Android systems' technical constraints.

It is the user's responsibility:

• to use export features offered by the application if they wish to retain their files;
• to understand that application uninstallation results in local data deletion.

Druidz cannot be held responsible for data loss resulting from voluntary application deletion or user manipulation.

13.4 Malfunctions

By derogation from the above, in case of proven malfunction exclusively attributable to Druidz, having resulted in abnormal quota consumption without effective service access, Druidz may, exceptionally, offer:

• either a recredit of the concerned quota,
• or an equivalent solution.

This assessment is subject to Druidz technical analysis.

13.5 Express Acceptance

By using offline download features, the user acknowledges having been informed:

• of the consumable nature of the quota,
• of the absence of refund after consumption,
• and expressly waives their right of withdrawal for this part of the service.

14. LEGAL COMPLIANCE

14.1 GDPR

Druidz complies with the General Data Protection Regulation (GDPR). For more information, see our Privacy Policy.

14.2 Consumer Protection

In accordance with consumer protection regulations, you benefit from a 14-day right of withdrawal, except if you have expressly requested immediate service execution (Premium content download).

14.3 Payment Services Directive (PSD2)

Payments are processed by Stripe, an approved payment service provider compliant with PSD2 directive.

16. TERMS OF SALE MODIFICATIONS

Druidz reserves the right to modify these Terms of Sale at any time. Modifications enter into force upon publication on the website and in the application.

In case of substantial modification (prices, quotas, features), you will be informed by email or notification in the application at least 30 days before modifications take effect.

If you refuse modifications, you can cancel your subscription before they take effect.

17. OFFLINE CONTENT, USAGE LICENSE AND SHARING PROHIBITION

17.1 Content Nature and Usage License

Digital content made available via the Druidz application, and notably offline cartographic files (MBTiles type files), constitute content protected by copyright and database rights.

Druidz grants the user a strictly personal, private, non-exclusive, non-transferable and non-commercial usage license, for the sole duration of their subscription or their service access right.

No intellectual property right is transferred to the user.

17.2 Authorized Use

The user is authorized to:

• View content within the application,
• Use downloaded offline files exclusively for their personal use,
• Store files on their personal devices compatible with the Druidz application.

17.3 Formal Prohibitions

It is strictly prohibited, without prior written authorization from Druidz, to:

• Share, transmit, lend or make available any or all offline files to a third party,
• Resell, rent, transfer or commercially exploit files, free or paid,
• Publicly distribute files, notably via Internet, social networks, forums, download platforms or physical media,
• Bypass, remove or alter any technical device for protection, traceability or usage limitation,
• Use files for professional, commercial or collective purposes.

Any non-compliant use constitutes a serious violation of these terms.

17.4 Content Traceability and Protection

Offline files provided by Druidz may integrate technical metadata allowing identification of their origin (notably user identifier, creation date, technical signature).

These metadata have the sole purpose of:

• Protecting Druidz rights,
• Fighting against unauthorized distribution,
• And establishing evidence of potential contractual violations.

They are not used for commercial purposes and are processed in accordance with applicable regulations on personal data protection.

17.5 Internal Contractual Sanctions

In case of violation of these provisions, Druidz reserves the right, without prior notice or compensation, to:

• Temporarily suspend access to the user account,
• Permanently terminate the user account,
• Remove access to content and associated services,
• Refuse any future new subscription.

No refund may be claimed in case of termination for serious breach.

17.6 Damages and Legal Actions

Independently of internal contractual sanctions, Druidz reserves the right to initiate any necessary legal or amicable action to obtain compensation for damages suffered due to unauthorized use of content.

Damages may notably be assessed with regard to:

• Lost profits suffered by Druidz,
• Number of files concerned,
• Extent and duration of distribution,
• Costs incurred for establishing facts and defending rights.

This assessment may be conducted amicably or, failing that, by any competent jurisdiction, without prior amount limitation.

17.7 Final Provisions

This article remains applicable after user account termination, for any unauthorized use or distribution prior or subsequent to said termination.

18. TERMS OF SALE ACCEPTANCE

By subscribing to a Druidz Premium subscription, you expressly accept these Terms of Sale.

19. GOVERNING LANGUAGE AND VERSION

These Terms of Sale are written in French.

In case of translation into one or more languages, only the French version shall prevail in case of divergence, interpretation or dispute.
